Introduction and Consent to Terms of Use and Privacy Policy
MyCommunitySource.com is a website operated by The Source LLC that offers news and other resources for community view. By using The Source’s services, users agree to be bound by these Terms of Use and Privacy Policy. Users who do not agree to these Terms of Use and Privacy Policy should not use The Source’s services. The Source reserves the right to modify, add or delete portions of these terms at any time and at its discretion. Please check the Terms of Use and Privacy Policy frequently for updates. Any modifications to these terms or Privacy Policy will be effective immediately upon posting. Continued use of The Source’s services means that a user agrees to those changes.

Use of the Service
The Source’s services are solely for personal and non-commercial purposes. All applicable laws, rules and regulations and any agreements or terms with third parties to which users are subject still apply. Those who want to use The Source’s services in any other manner are required to obtain written consent or a separate agreement with The Source.

The Source’s website contains news, feature stories, photographs, graphics, videos, audio and other content, as well as businesses, municipal, public, nonprofit and other third party information. The Source’s services will also provide other ways to access and use information and materials. The Source’s website may contain links to Internet sites, applications and services maintained by third parties, over which The Source has no control. The Source does not endorse the content, operators, products or services of such sites and is not responsible or liable for the content, operators, availability, accuracy, quality, advertising, products, services or other materials on or available from such sites. The Source shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, products or services available on or through such sites. The Source website may also give users the options to receive emails and bookmark items in other social networking services. The Source makes no guarantee that such information is accurate and use of the information provided is at the user’s own risk. The user agrees not to hold The Source liable for any inaccurate, incomplete, outdated or missing information on the website.

The Source’s services may allow users to share, post, upload, transmit and or otherwise submit comments, messages, text, photos, images, story ideas, essays and other content and materials, and make recommendations on or through its website. Users acknowledge that The Source retains the right to use, screen, refuse to post, redact and edit the content they submit at any time and for any or no reason at its sole discretion without prior notice, although The Source has no duty to do so. If The Source elects to screen user materials, there may be a delay in posting the content to allow for a review process. If The Source has questions about any user content, The Source has the right, but not the duty, to contact the user for further information, including, for example, that the user owns the copyright or otherwise have the rights to post the content submitted. The user further acknowledges that The Source may use the content submitted for third party and advertising purposes. The Source is not required to seek user approval or to provide the user with any compensation in connection with its use of any content submitted. The user further acknowledges that nothing contained within the content submitted would require The Source to seek permission of a third party in order to use that content. The user retains the copyright and ownership rights of any content submitted on or through The Source’s website. However, by submitting content through The Source’s services, the user hereby grants The Source and other content providers and its respective licensees, a nonexclusive, perpetual, royalty-free, worldwide transferable license to use copy, sublicense, modify, transmit, publically perform, display, create derivative works of, host, index, cache, tag, encode, and/or adapt user materials in any and all media formats or channels, whether now known or hereinafter devised, including, but not limited to, The Source’s services, applications, third party licensee websites, applications and other services without payment, further consent or notice to the user. In addition, the user grants anyone who uses The Source’s services a nonexclusive, royalty-free worldwide license to use the content submitted on or through The Source’s services and applications to use the content submitted pursuant to these terms of use.

Rules for Use of Service
Users must be 13 years of age to register for or participate in The Source’s services or other social networking features of The Source; submit any user materials or personally-identifying information on or through The Source’s services; participate in any online contests; register for email, newsletters or other features of The Source services. Users under the age of 13 must have the consent of a parent/guardian to browse The Source’s services. Users under the age of 13 must provide The Source with written consent of a parent/guardian to submit any content or material to The Source’s services. The Source retains the right, but does not have the duty, to remove any content submitted by a user under the age of 13.

Users may not submit any materials or content anonymously or under a false name or a false email address. Users may not impersonate other users or provide any false information. Users may not submit any materials or content or links to materials that is libelous, defamatory, false, obscene, indecent, lewd, pornographic, violent, abusive, threatening, harassing, discriminatory, in violation of the law, harmful to children, in violation of third-party privacy rights, or that constitutes hate speech or a personal attack. Users may not submit content that contains masked profanity. Users may only submit materials or content that they have the copyright or necessary rights and permission to distribute electronically. Users may not violate, plagiarize or infringe on the rights of third parties, including copyright, patent, trademark, trade secret, privacy, personal, publicity, moral or proprietary rights. Users cannot submit content or material that infringes or violates another party’s intellectual property rights. For example, most music is copyrighted and therefore cannot be used as background for videos or photograph slideshows. Users cannot submit any material containing solicitations of funds, advertising, promotion, goods and services or recruiting. Users may not use The Source’s services for political campaigning, recruiting votes or soliciting support for legislative or other initiatives.

Users should not interfere with the integrity or performance of The Source’s services in any way that degrades the website’s reliability, speed or operation. Users should not attempt to gain unauthorized access to The Source’s services. Users should not submit any software or other material that may harm The Source’s website, computers, files, programs or other property with a virus, worm, Trojan horse or other detrimental computer code, file, script, agent, program or device. Users should not use The Source to distribute chain letters, mass mailings, “spam,” or unsolicited messages in violation of applicable laws or to gather usernames and/or email addresses for the purpose of sending unsolicited email or other communications to other users of The Source’s services.

The user is solely responsible for any material or content submitted to The Source. The Source does not and cannot review all user material or content and is not responsible for any material or content submitted on or through The Source’s services. However, The Source retains the right, but not the obligation, to review, screen or delete any user material that it deems to be in violation of the terms of use or for any other reason that The Source determines in its sole discretion. The Source is not responsible or liable for any material or content submitted by its users or other third parties. The Source cannot verify the accuracy of statements that users make or place on or through its services and does not guarantee that the user materials have been submitted with copyright or proprietary owner permissions or otherwise comply with these terms of use.

The relationship between The Source and those using its services does not create a duty on the part of The Source to avoid negligent misstatements of fact. The Source is not liable for factual misstatements of authors or advertisers whose messages its services carry. Furthermore, The Source is not liable for negligently publishing inaccurate or misleading classifieds or advertisements. The Source has no duty to investigate the accuracy of classifieds or advertisements used in any of its services. Users hereby acknowledge and agree that if a dispute arises between users of The Source’s content and/or services or between a user or users and any third party The Source is under no obligation to become involved and users agree to release The Source from any such claims, demands, damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed arising out of or in any way related to such disputes and/or The Source’s website and services. Under no circumstances, including, but not limited to, negligence, will The Source or its affiliates be liable for any direct, indirect, incidental, special or consequential damages that result from the use of, or the inability to use The Source website and services, including materials, products or third-party materials made available through this site, even if The Source is advised beforehand of the possibility of such damages. Because some states do not allow the exclusion or limitation of certain categories of damages, the above limitation may not apply. In such states, The Source’s liability and the liability of The Source’s affiliates are limited to the fullest extent permitted by such state law. Anyone who uses The Source’s website and services acknowledges and agrees that The Source is not liable for any defamatory, objectionable, indecent, offensive or illegal content and/or conduct of any user. Users dissatisfied with The Source’s website or any of its materials, services or products or with any of The Source’s terms and conditions should stop using The Source website and services.

The Source is under no obligation to screen or monitor content but may review content at its sole discretion, which may include editing or removing content at any time without notice. Users of The Source’s services shall not use spiders, robots, data mining techniques or other devices or programs to catalog, download or otherwise reproduce, store or distribute The Source’s content. Furthermore, users of The Source’s services shall not use any means to manipulate The Source’s content or services or attempt to exceed the limited authorization and access The Source grants under these terms of use. Users shall not resell use of, or access to, The Source’s services to any third party.

The Source can charge a fee for classifieds and fees are not refundable. Users posting a classified on The Source are responsible for complying with the laws and regulations that govern the types of goods and services bought, sold or exchanged as well as the manner in which they are bought, sold and exchanged. The Source prohibits users from offering and soliciting prostitution and other illegal activities, obscene and pornographic material, weapons, controlled substances, drugs, drug paraphernalia, scams, hazardous items, counterfeit items, illegal items, stolen property, restricted items and other related items. Users should report classifieds that violate these terms or any applicable law to The Source.

Users acknowledge and agree that The Source can suspend, limit or terminate access to any and all of The Source’s services at any time with and without notice and with or without cause. Users acknowledge that The Source may report illegal activities and any associated information, including user identity, to the proper authorities.

Copyrights
The Source’s contents are protected by U.S. and international copyright laws. The Source’s contents are owned by or licensed to The Source and others who provide content to The Source’s services. In the case of user submitted materials and content, their contents are licensed to The Source by the user. No one should reproduce, distribute, republish, upload, transmit, display, prepare derivative works of, publically perform, sell, transfer, assign, license or use for commercial purposes any copyrighted material on The Source’s services without proper written consent to The Source. All rights not expressly granted in these terms of use are reserved to The Source.

Users may copy, download one copy on a single computer, and print a limited amount of content for personal, non-commercial use only, provided that the user includes all copyright and other proprietary notices contained in the content, does not modify the content and does not use the content in any way that is unlawful or harmful to any other person or entity. Furthermore, users may use widgets and tools on The Source’s services that allow selected user materials to appear on their personal, noncommercial website, weblog or other applications subject to the conditions set forth in the copyrights section of these terms of use.

Quotes from The Source’s services cannot be used in any other medium without attribution to The Source.

Hold Harmless Agreement and Summary
The Source shall not be held responsible for any user of its services who disregards these terms and conditions. Users of The Source’s services agree to defend, indemnify and hold harmless The Source, its owners, employees, business partners and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, expenses, and attorney fees arising from any user’s breach of these terms and conditions, user content, user’s use of The Source’s content and services or user’s violation of the law or other applicable regulation or agreement. The laws of the State of New Jersey shall govern these terms of use. All users of The Source’s services hereby consent to exclusive jurisdiction and venue in the courts located in Monmouth County, New Jersey for all matters arising in connection with these terms of use or the use of The Source’s services. Any alleged claim regarding The Source’s services must be submitted to The Source in writing within one year of the date the claim first arose or such claim is void. Any alleged claim shall be submitted individually and shall not be combined with any other third party claim or such claim is void.

If a court of competent jurisdiction deems any part of these terms and conditions invalid or unenforceable such decision will not affect any other part of these terms and conditions. If The Source fails to partially or fully exercise any rights, remedy or waiver regarding these terms and conditions this shall not preclude The Source from subsequently exercising any rights, remedy or waiver regarding these terms and conditions.
